1. Acceptance of Terms

By accessing the website at www.theclearpathinvestigations.com or engaging the services of Clearpath Investigative Services LLC ("Clearpath Investigations," "we," "our," or "us"), you ("Client" or "you") agree to be bound by these Terms and Conditions. If you do not agree, you may not use our website or services.


2. Services Provided

Clearpath Investigations is a licensed and bonded private investigative firm operating in New Mexico and the Southwest region. Our services include, but are not limited to:

Surveillance Investigations (infidelity, insurance, legal)

Business & Insurance Fraud Investigations

Background Investigations

Missing Persons & Skip Tracing

Accident Scene Investigation

Technical Surveillance Counter-Measures (TSCM)

All services are subject to a separate written engagement agreement signed prior to commencement of any investigation.


3. Licensing & Legal Compliance

Clearpath Investigations holds all required licenses and bonds to operate as a private investigative agency in the State of New Mexico. All investigations are conducted in full compliance with applicable federal, state, and local laws. We do not engage in any activity that violates the law, including unauthorized interception of communications, illegal trespass, or impersonation of law enforcement.


4. Client Obligations

As a client or prospective client, you agree to:

Provide accurate and truthful information in connection with your inquiry and engagement

Use investigative results only for lawful purposes

Not request or direct us to conduct any investigation that violates applicable laws

Keep your case number and any confidential communications secure

Providing false or misleading information to induce an investigation may constitute a criminal offense. We reserve the right to terminate any engagement and report suspected illegal activity to the appropriate authorities.


5. Engagement & Fees

5.1 All investigative services require a signed written engagement agreement and an advance retainer before work commences.

5.2 Fees are based on the nature, scope, and complexity of the investigation. A detailed fee schedule will be provided prior to engagement.

5.3 Retainer funds are applied against billable hours, expenses, and costs. Unused retainer balances are refundable upon request after final billing.

5.4 Additional costs incurred during an investigation (travel, database fees, court records, etc.) are billed to the client at cost.

5.5 We reserve the right to suspend or terminate an investigation if payment obligations are not met.


6. Confidentiality

All client information, case details, and investigation results are strictly confidential. We will not disclose the existence of an engagement or any case information to any third party except as permitted under our Privacy Policy or required by law. Clients are likewise expected to maintain the confidentiality of investigative methods, personnel, and proprietary techniques.


7. Delivery of Results

7.1 Investigation results, reports, and evidence are delivered exclusively to the named client or their authorized legal representative.

7.2 All evidence is gathered using lawful methods and follows strict chain-of-custody protocols to ensure admissibility in legal proceedings.

7.3 We do not guarantee any particular outcome or result. Investigations are conducted professionally and diligently; however, findings are subject to the facts and circumstances uncovered.

7.4 Digital evidence and reports are delivered via secure, encrypted channels. We do not mail physical DVDs or unsecured media.


8. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, CLEARPATH INVESTIGATIONS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF OUR SERVICES OR WEBSITE. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT PAID BY YOU TO US IN THE THREE (3) MONTHS PRECEDING THE CLAIM.

We are not liable for decisions you make based on investigative results, nor for actions taken by third parties as a result of an investigation.


9. Disclaimer of Warranties

OUR WEBSITE AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT OUR WEBSITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR HARMFUL COMPONENTS.


10. Intellectual Property

All content on the Clearpath Investigations website — including text, images, logos, and design — is the property of Clearpath Investigative Services LLC and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without our prior written consent.

Investigation reports and deliverables prepared for a client are the property of the client upon full payment of all fees. We retain the right to maintain a confidential copy for our records.


11. Termination

Either party may terminate an engagement upon written notice. Upon termination:

You will be billed for all services rendered and expenses incurred through the termination date

We will deliver all work product completed to date

All confidentiality obligations survive termination indefinitely

Any unused retainer balance will be refunded within 14 business days


12. Governing Law & Dispute Resolution

These Terms and Conditions are governed by the laws of the State of New Mexico, without regard to its conflict-of-law provisions. Any dispute arising out of or relating to these Terms or our services shall first be submitted to good-faith mediation. If mediation fails, disputes shall be resolved by binding arbitration in Bernalillo County, New Mexico, in accordance with applicable arbitration rules.


13. Indemnification

You agree to indemnify, defend, and hold harmless Clearpath Investigative Services LLC, its officers, investigators, employees, and agents from and against any claims, liabilities, damages, losses, or expenses (including attorneys' fees) arising out of or in connection with your use of our services, your breach of these Terms, or your violation of any law or the rights of a third party.


14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.


15. Entire Agreement

These Terms and Conditions, together with our Privacy Policy and any signed engagement agreement, constitute the entire agreement between you and us regarding your use of our services and supersede all prior agreements or understandings.
